Trentra I-Tres

So far wala naman akong regrets.

It was fun!

Last December 26, I flew back home urgently because of some emergency situation without informing my employer. I was able to inform them only upon my arrival. They want me back on Jan 15 but I would like to stay home to take care of my sick mother and my children. I plan to just work here.

What charges my employer can legally press on me aside from absconding? They have granted me a loan which I issued some checks as a guarantee (which don't have funding) to pay my loan to the old company. If they will file an estafa case against me, is that possible even if I am in the Philippines already? They don't know yet my plans of not coming back so I can yet tell them that I will pay them once I have a job here already.

My visa was all arranged already. I was actually just waiting for my labor card before I went home.

My problem is I am not sure if they have presented the check as of today. If they havent, no problem but if they will in the next days, my another problem is, can they still file a case against me even I am in the Philippines already? Another thing is, if they present the check once I come back (they're willing to shell off for the ticket and resettling in dubai), I will be sent to jail also?

Am really confused! One of the reasons I went home was I got a bad trouble in my cousin's flat. I actually went home with swollen face and head so I got really traumatized.

Please advise the legal implications if I decide not to come back anymore.

  4. hi shattered soul. i will try to answer your questions in the best of my knowledge.

your in a deep hole my friend but the good news is that the labour law states that the company is not allowed to file an absconding case against you while abroad. But you may get in too big trouble once you company file a civil case against the bouncing check. in the banks case, some say that that the banks have collecting agents outside UAE.

try to negotiate with your company regarding the payment terms of your company loan if you are willing to pay.

  5. thanks. i already sent them an email expressing my intention to settle my obligations and requested them that we come up with amicable terms to settle it. the amount is only 5k but i know that the amount is not the issue here. i was thinking that they could possibly use this as an issue to get even with me because i left in lurch.
